Resah is expanding the generative AI purchasing options for healthcare institutions. An award notice published on BOAMP on 11 September 2026 assigns to Orange Business Services and COM NETWORK two lots for access to a multi-model platform, with an overall ceiling of €100 million over four years. The estimated value is €20 million. The framework agreements are concluded without a minimum: these amounts therefore do not represent expenditure already committed by hospitals.

The notice specifies the division of roles. Orange Business Services wins lot 1, accessible in intermediary mode; COM NETWORK lot 2, in wholesaler mode. These are two single-award framework agreements executed by purchase orders. Each lot has a ceiling of €50 million and an estimated value of €10 million.

Two ordering channels

The difference lies in the purchasing organisation. In intermediary mode, Resah places the contract on behalf of its beneficiaries, who then access it. In wholesaler mode, the central purchasing body buys and then resells the services to institutions. This second channel allows the beneficiary to order from Resah, which manages the purchasing relationship with the contractor.

Three bids were received for each lot. The awards date from 19 August and the contracts from 3 September. The notice indicates a period from 7 September 2026 to 6 September 2030, with an initial duration of two years renewable twice for one year. The contract references are 2024-R055-001-005 and 2024-R055-002-005. The consultation falls under category 62 of Resah's dynamic purchasing system 2024-R055.

The document mentions criteria of price, quality of the software solution, associated services, innovation and consideration of social and environmental concerns. It refers to the consultation documentation for their detail and weighting. The number of bids does not allow counting distinct competing companies: the same candidate may have bid for both lots.

The notice also identifies COM NETWORK, based in Aix-en-Provence, with its establishment number. However, it does not detail either the platform or the models that this contractor will supply. The wholesaler modality describes the role of the central purchasing body; it is not sufficient to deduce that COM NETWORK would be a reseller of a particular solution.

Orange already referenced by Resah

This award complements an existing offer. The contract 2024-R056, dedicated to Orange solutions and services around AI, is open from 28 August 2024 to 27 August 2028. It is a single-award framework agreement with subsequent contracts, offered in intermediary mode. Its sheet covers software, computing resources and support services.

The catalogue distinguishes Live Intelligence Trust, based on a LightOn model and operated on Cloud Avenue in France, from Live Intelligence Open, which gives access to several models. The sheet locates the infrastructure of this second offer in Europe. It also includes on-demand graphics processors and training or use-case definition services. These characteristics belong to contract 2024-R056; they cannot be automatically attributed to the new lots.

The case of GHT Rouen Cœur de Seine illustrates the intended uses. Orange indicates that its nine institutions chose Live Intelligence for an environment intended for their 15,000 professionals. According to its press release, some preparatory work for research grant applications went from three weeks to two days. This result declared by the supplier concerns specific tasks; it measures neither the complete time to obtain a grant nor a gain generalisable to all institutions.

The new notice thus sets up orders through two channels, with one contractor per lot and explicit ceilings. It does not allow comparing unit prices with those of the previous contract, as no price schedule is published in the announcement. Nor does it establish commercial exclusivity for these suppliers across the entire hospital sector.

Conditions of use remain decisive

The subject of the contract promises access to several models, but the notice gives neither their list nor the locations where each service will be executed. It also does not mention any health data hosting certification. This absence in an award notice does not prejudge the content of the technical and contractual clauses.

The requirements depend on the data and tasks entrusted to the platform. Drafting specifications without patient data and analysing a medical record do not present the same framework. The Agence du numérique en santé reminds that hosting, on behalf of a third party, personal data collected in the context of prevention, diagnosis, care or medico-social follow-up falls within the scope of the HDS scheme. The location of a server in France is not sufficient, on its own, to demonstrate this compliance.

The GDPR also imposes a data protection impact assessment in the situations provided for by its Article 35, notably for large-scale processing of sensitive data, as explained by the CNIL (France's data protection authority). Institutions must therefore qualify the data transmitted, retention periods, subcontractors and possible transfers, according to the chosen use.

The European AI regulation adds a distinction between the model and its application. Obligations targeting general-purpose models have applied since August 2025, with a transitional regime for older models. An application intended for medical use may fall under high-risk systems if it meets the criteria applicable to regulated products. According to the Commission's updated timeline, the corresponding rules for systems integrated into Annex I products will apply on 2 August 2028. A generalist platform used in a hospital does not automatically receive this qualification.

Audit also becomes a purchasing object

Another notice, published on 16 September by the City of Lyon and its communal social action centre, illustrates the control needs accompanying these deployments. Consultation 26-89106 concerns compliance with the GDPR and the AI regulation. The audit lot is capped at €200,000 excluding tax over its total duration, and the legal support lot at €85,000. Bids are expected by 21 October. This is a separate contract, with no established link to Resah.

Regarding the new hospital lots, the contractual documents will allow assessing what is included in the service. The notice expressly provides that a copy of the contract may be requested in writing from Resah, after redaction of information protected by law. The accessible models, data guarantees and order prices remain the elements needed to turn this purchasing ceiling into a deployment decision.
