Sensitive Data and Cloud Act: Microsoft France Admits It Cannot Oppose an American Injunction

Created in 2019, the Health Data Hub (HDH) is a French public interest group aimed at facilitating secure access to health data for research, evaluation, or the development of innovative solutions. By integrating various data sources, such as the Système National des Données de Santé (SNDS), hospital databases, or data from general practice, the HDH provides a rigorous framework combining anonymization, traceability, and scientific evaluation of projects.
The HDH stands out for its ability to integrate health databases to foster innovation in healthcare. Its expertise lies in the secure management of sensitive data, allowing researchers and medical solution developers to access valuable information while adhering to data protection standards. The HDH has been at the forefront of managing the health crisis, providing essential resources to research teams. It also won the European Medicines Agency's tender to create the EMC2 health data warehouse, which centralizes data from several European healthcare institutions.
Among recent initiatives, the HDH has relaunched the "Data Challenges in Health" call for projects, encouraging medical sector professionals to organize data science competitions on medical themes. These challenges aim to address specific medical issues using artificial intelligence (AI). Additionally, the Unibase project, in partnership with Unicancer, aims to create reference databases in oncology to accelerate cancer research using real-world data.
The HDH also plays a key role in developing the European Health Data Space (EHDS), coordinating a consortium to create a test version of this European initiative that will standardize access to health data across the EU.
The HDH holds a central position in the digital health technology ecosystem in France and Europe. A key player in the France 2030 project and the Digital Health Acceleration Strategy, it collaborates closely with public institutions, private companies, and research organizations to drive innovation in healthcare. The HDH is also integrated into PariSanté Campus, a digital health innovation center aiming to make France a global leader in this field.
The HDH is currently transitioning to sovereign cloud hosting, addressing data security concerns raised by its initial hosting on Microsoft Azure. This migration, scheduled for the summer of 2026, is part of the SREN law that requires operators handling sensitive data to use providers offering sovereignty guarantees. Among the candidates to host the HDH are European companies such as OVHcloud and Scaleway.
Furthermore, the CNIL recently authorized the HYDRO project by Implicity, the first project to access HDH data, aiming to predict heart failure crises using AI. This project illustrates the potential of the HDH as a platform for vital medical innovations.
In conclusion, the Health Data Hub is a pillar of innovation in digital health, facilitating secure access to health data for research and technological development. Its ability to navigate the complex challenges of data security and cross-sector collaboration makes it an indispensable player for the future of personalized medicine and public health.
